‘High Court refuses to overrule itself on advocates’ immunity’

“Yesterday, in Attwells v Jackson Lalic Lawyers Pty Limited [2016] HCA 16, a majority of the High Court upheld the appeal of a man who wanted to sue his lawyers for negligence over advice they gave him that led him to settle a dispute about a bank guarantee that ended up being very costly for him. However, while refusing to extend advocates’ immunity to work that leads to an out-of-court settlement, the Court also unanimously refused to reopen two earlier decisions where majorities of previous High Court benches had held that advocates are generally immune from civil actions concerning the advice they give in relation to court proceedings that proceed to judgment …” (more)
