ABSTRACT
Estate planners need to be aware of the prevalence and myriad manifestations of addiction to be able to address the issues it creates in a family’s estate planning documents. A well-drafted trust can go a long way toward helping a family and an addicted beneficiary through the stages of recovery, relapse, or the choice not to seek treatment. The estate planner cannot solve the problem, but can help a client assemble a team of professionals, guided in part by a trust agreement. Wendy S Goffe provides members with commentary that reviews the drafting of trusts for beneficiaries with addiction issues. Readers will find her commentary most helpful as it contains a variety of sample trust provisions.
