Vidhi Nawal, ‘Licensing Agreements and Consumer Interests’

ABSTRACT
Licensing agreements have become the most prevalent way of controlling access to digital commodities and services. Not anymore do consumers own the items bought; rather, consumers receive licenses from sellers, allowing them to use the products via contract-based relations. While licensing agreements are very helpful and useful for innovations, for protecting intellectual property rights, and for distribution all over the world, they face certain difficulties as far as consumer interests are concerned.

The focus of this work will be on the connection between license agreements and consumer interest with the aim of studying the relationship between contractual freedom and consumer protection. Using the method of doctrinal research, an analysis will be conducted as to the legal regulation of licensing, the prevalence of end-user license agreements, informational disadvantages, inequality of the parties, limitations to ownership rights, and actions taken in order to overcome the aforementioned problems by consumer and competition authorities.

It turns out that despite being extremely important in the contemporary world of digitization, there is a variety of issues concerning licensing which should be solved. In this regard, some suggestions on how to solve the problem and make the legal regulation of licenses more efficient for protecting consumers’ rights are provided.
