Peter Menell, ‘Charting the Making of the Copyright Act of 1976’

ABSTRACT
This manuscript reconstructs the making of the Copyright Act of 1976 through a close comparative study of the major drafts, reports, hearings, and compromise provisions that emerged over a twenty-year legislative process beginning in 1955. By charting the evolution of the principal draft provisions and their transformation into enacted law, the manuscript provides a detailed roadmap for understanding both the structure of the 1976 Act and the legislative choices that continue to shape modern copyright interpretation.
