ABSTRACT
The WTO TRIPS Agreement was adopted in Marrakesh on April 15, 1994, and entered into force more than three decades ago. The 30th anniversary of this landmark multilateral agreement provides an ideal juncture for reviewing the instrument in relation to the debate on intellectual property and global justice. To help illuminate this debate, the present chapter focuses on three concepts that can be used in the contexts of the TRIPS Agreement as well as other areas of intellectual property law and policy: (1) just transition, (2) selective adaptation, and (3) enabling environment. Using developments relating to the TRIPS Agreement, this chapter illustrates how these concepts can be utilized to advance the debate on intellectual property and global justice.
