ABSTRACT
Vietnam strictly prohibits cryptocurrency as a medium of exchange and remains silent on whether it is considered a type of property, leaving this issue in a ‘grey area’. This article undertakes a comprehensive analysis of recent court decisions in Vietnam, scrutinising their interpretation within the context of current Vietnamese cryptocurrency regulations. In light of inconsistencies identified in various judgments, the author advocates for a proactive approach by the state to promulgate legal instruments that formally acknowledge cryptocurrency. The insights and findings presented aim to contribute to the ongoing discourse on cryptocurrency regulation, offering valuable perspectives for policy-makers and legal scholars alike.
