Norhan Moussa, ‘The Applicable Law to International Employment Contracts: A Private International Law Perspective’

ABSTRACT
The globalization of labor markets has brought unprecedented challenges in determining the applicable law to international employment contracts. As cross-border employment relationships grow, conflicts of law issues arise, particularly concerning the choice of law and the protection of employees’ rights. This research examines the main principles governing the applicable law to international employment contracts, including party autonomy, the default rules in the absence of choice, and the role of mandatory and public policy rules. It analyzes the influence of international conventions such as the Rome I Regulation and relevant case law, offering a comparative view of American and European approaches. The paper highlights emerging challenges such as remote work and proposes recommendations for balancing legal certainty and employee protection in the evolving labor market.
