ABSTRACT
The concept of transnational law is regularly employed with at least two meanings. The first meaning focuses on understanding transnational law as a legal system. The second meaning puts forward the understanding of transnational law as methodology. This methodology can be employed either to connect – in order to disconnect – the legal orders and quasi-legal orders, either vice-versa. For the purposes of writing this article, we are resorting to the methodology of transnational law to illustrate some ways in which the markets are operating under the umbrella of transnational law, understood as a legal system. As transnational law is deeply interrelated with the harmonization and unification of markets, the paper explores how concepts such as transnational contract and transnational usage, indicators and standards, and the corporate codes of conduct are relevant, in their mutual and evolving interplay, in the markets’ harmonization and the unification processes, if any.
