ABSTRACT
This is a response to the Ministry of Justice’s consultation on ‘Reforming the Law of Apologies in Civil Proceedings in England and Wales’. I argue that the case for legislative reform in not made out in the consultation, and that there are concerns around the coherence of the proposals and how they may generate further problems. Other non-legislative steps have been and can be taken to address the relevant issues.
