Ademola Adekunbi, ‘A Critical Evaluation of Whether the UK System of Copyright Infringement Should Be Simplified’

ABSTRACT
The United Kingdom’s Copyright, Designs and Patents Act 1988 (‘the Act’), is the governing statute which details intellectual property rights within the country, as well as the permitted acts, defences and other details related to those rights. This article evaluates the provisions relating to copyright specifically, with a view to ascertain whether there is an opportunity or indeed an imperative to reform the Act and make it better fit for its purpose, by reducing the complexity of said provisions. The evaluation proceeds from two focal points: The first one is how easily citizens can ascertain the extent of their rights to interact with copyrighted work, and the second is how effectively rightsholders are able to enforce their copyright.
