ABSTRACT
The digitalisation had started to interfere with private autonomy long before digital tools became autonomous, but they influenced rather form than content. Digital autonomous tools, however, reach to the core of private autonomy – the right to shape one’s legal environment of own accord. Just as with data, people tend to waive this right out of commodity when tempted by useful autonomous devices at hand. And just as the GDPR reacted to this phenomenon by establishing privacy by design-requirements, the need for respective protection mechanisms for private autonomy may be arising as well. This paper analyses the impact of digital autonomous tools on private autonomy and intends to point out gaps of protection as well as possible measures to alleviate these shortcomings.
