ABSTRACT
Is absolute subjective law a vanishing #copyright paradigm? Is the CJEU developing access rules of maybe norms of transaction also called non-autonomous but interdependent? Should a different, new construction of subjective copyright be proposed nowadays? Should the exclusive right of the author be reflected somehow in the mirror of its social function and actions taken by the right users themselves? Lies the source of the tension in the specific understanding of the philosophy of Immanuel Kant (1724-1804)? Are we students of Kant’s student Johann Gottlieb Fichte (1762-1814). Did he place a trap for subjective copyright? Is the minimum level of protection also called ‘kleine Münze’ or ‘petite monnaie’ in copyright law a flawed concept? Should we not read Jan Śniadecki (1756-1830) who seems still up-to-date? I welcome you to read the presentation that I had the pleasure to make on June 2, 2022 at the Institute of Law Studies, Polish Academy of Sciences.
