ABSTRACT
This book chapter examines the legal nature of Chinese charitable trusts. Charitable trusts in China are still in their formative stage, and there exists a great deal of uncertainty in the operation of this model. In light of this, an examination of the legal nature of Chinese charitable trusts is of great significance in both theory and practice. On the one hand, it may clarify the relationship between charitable trusts and analogous institutions (for example, public welfare trusts), so as to better understand what roles charitable trusts are intended to play, in what way they may relate to other forms of charities, and to what extent the law may draw from analogous institutions when developing charitable trusts. At a macro level, this study can help to assess what efforts Chinese legislators have made in advancing state-society relationships, so as to better understand what role private actors may play in the construction of civil society in China.
