ABSTRACT
An examination of the formation and the effect of the special conditions in the Berne Convention on Copyright which allow for the compulsory licensing of copyright books by the developing country members of the Convention. It asks whether membership of the Berne Convention has helped developing countries to provide educational materials at an affordable cost. The paper explains why compulsory licensing was offered, why the developing country members of Berne thought that it would be effective, and why it has not worked. The need for low-cost educational books remains, and means of addressing the need are suggested.
