Craig Estlinbaum, ‘Book Review: Restitution Revisited’

Abstract:
This essay reviews Ward Farnsworth’s 2015 book Restitution: Civil Liability for Unjust Enrichment, a thorough yet accessible that serves as a useful guide into this versatile legal area. Restitution, generally speaking, is a legal action to compel the surrender of a benefit obtained through an improper or unjust means to the property’s rightful owner. Sometimes termed unjust enrichment, quantum meruit or merely restitution, this cause of action has precise rules and requirements that are often overlooked in legal education and confused by practitioners and judges alike. Farnsworth’s clear and concise book makes a valuable contribution to this important field and would be an important addition to any practitioner’s bookshelf.
