Christian Twigg-Flesner, ‘The Consumer Rights Directive, Consumer Sales and English Law – the Fear of Coherence?’

Abstract:
This paper explains how the Consumer Rights Directive (CRD) was implemented in the United Kingdom. Although the implementation largely copies out the text of the CRD verbatim, the original proposal for a more detailed directive started a wider process of reforming and modernising UK consumer law, resulting in the Consumer Rights Act 2015. This paper also considers how the EU’s special rules for consumer sales fit into the landscape of general sales law, and comments on the possible impact of the proposed Common European Sales Law (CESL).
