ABSTRACT
This Article makes a contribution to the literature regarding the extraordinary force of nature defense as well as the emerging law review literature relating to the COVID-19 pandemic by analyzing the possible applicability of the extraordinary force of nature defense as a defense to COVID-19 liability claims. Given the extraordinary nature of the COVID-19 pandemic and the recognition of it as an ‘extraordinary’ event by federal courts, I contend that courts should seriously consider its application as a common law defense to COVID-19 related liability claims.
