Beata Kornelius, ‘The Topicality of the Law Division into Public Law and Private Law’

Abstract:
The public and private law are two subsets of the legal system isolated pursuant to horizontal organisation, to which, according to classification (as stated by the opponents of the thesis about disjunctive division of the law on public and private law), or solely typological criteria, assignment of separate branches of the law is done. However, the controversy related to the division of the law according to horizontal organisation into both mentioned subsystems is not only a dispute over criteria but also over the importance of such a division in the process of application of the law. The author of the article aims at demonstrating that the division of the law into public and private is topical and, above all, plays a significant role in the process of application of the law, including its interpretation.
