Peter Ras, ‘Owning the Universe: Exploring the Concept of Property Rights in Outer Space’

Abstract:
Outer space is both beautiful and frightening. Not only in its appearance with supernova’s, coloured nebulas and supermassive black holes, but also in the legal regime that currently applies to space activities. A regime that provides both rights and freedom to all mankind and on the other hand does not seem to establish a very practical legal framework. Given the actuality of increasing utilization and exploitation of space’s natural resources, the current ‘space property’ regime, based on common caretaking principles, may prove unsuitable in the future. This article hopes to provide an exploration of the concepts of space as a common province of mankind, basic principles of property rights in outer space and a few suggestions for improvement.
