Abstract:
The Draft Regulation on a Common European Sales Law (CESL) deals with prescription in Articles 178–186. This article discusses the level of legal harmonization achieved within the European Union (EU) concerning extinctive prescription. Reference is made to a number of significant inaccuracies that might substantially affect the effectiveness and implementation of the Optional Instrument, which would benefit from an amendment before becoming EU law.
