Fahad Shahbaz, ‘The Integration of Human Rights within Corporate Law’

ABSTRACT
It has been observed over the past decade or so that there has been a heightened interest and development towards human rights and its violations within the corporate sector globally and domestically at the state level. At some level the impact of corporations on human rights is underestimated, it can affect the people associated whether in form of employees or labor positively and negatively. Human rights infringement can be grave in cases if corporations fail to pay attention. John Pollexfen aptly said “”Companies have bodies, but they have no souls; if no souls, no consciences”, Human rights preservation shall be treated as preserving the soul of a corporation. This dissertation aims to highlight the development made on the international level including the UN and the European Union as a response to the aforementioned concern (in the form of soft law). Case studies shall be analyzed to show how corporations can and have in the past implicated themselves and indulged in gross human rights violations. Furthermore, a comparative analysis shall be drawn on how different countries including United States, United Kingdom and the European Union have implemented the said directives and how developing countries like Pakistan can utilize the said models to improve their corporate sector. This paper shall also evaluate the existing scholarly debate on the said area along with the laws and regulations to draw a conclusion on how to establish a modus operandi for businesses to incorporate human rights within their existing structures for transparent standards of accountability.
