ABSTRACT
Medicine is one of the fields most affected by the development and application of artificial intelligence. However, this progress raises difficult ethical and legal issues, particularly in cases of harm caused by medical devices that are capable of making autonomous decisions. When assessing the physician’s behavior, it is important to assess the level of control over the device and the accuracy with which the patient has been informed. The precision and sophistication of these devices should not be neglected, and their development should be encouraged by appropriate and targeted non-repressive liability regimes.
