ABSTRACT
Every legal system must deal with situations in which one party claims a prior, or better, right to some object in virtue of having had a right to that (or another) object in a chain of dealings. In the common law tradition, these situations are dealt with under the topics of ‘tracing’ and ‘following’. Tracing and following are somewhat forbidding topics for many lawyers, perhaps because they are not typically taught as a single law subject in university curricula, but in passing in other subjects (typically, equity, property, or restitution).
