Sharon Shakargy, ‘De Facto Relationships in Israel’

ABSTRACT
This article examines the legal recognition and implications of de facto relationships in Israel, where marriage is governed exclusively by religious law. In response to the lack of civil marriage, three alternative frameworks have emerged: ‘leap marriages’ (civil marriages performed abroad), Spousal Covenants (for citizens without religion), and Reputed Couples (unregistered cohabiting partners recognised by courts). The article analyses the formation, rights, and dissolution of each model, showing how Israeli law increasingly affords de facto partners rights similar to those of married couples. It also highlights the legal ambiguities surrounding these relationships and questions whether, in light of their growing legal equivalence, marriage in Israel retains any unique significance.
