ABSTRACT
This paper examines the intersection of artificial intelligence (‘AI’) and dispute resolution, particularly in the context of online dispute resolution (‘ODR’) and its integration into judicial systems. The rise of digital technology has transformed traditional dispute resolution methods into ODR, blurring distinctions between formal and informal processes, as well as between online and offline resolution avenues. AI’s entry into dispute resolution primarily manifests through predictive analytics, heralding the emergence of AI-driven dispute resolution (‘AI-DR’). AI’s utilization is expanding across legal and alternative dispute resolution domains, with anticipated growth in its role in the foreseeable future. Key considerations include designing AI systems to optimize efficacy while addressing challenges such as bias and transparency. Upholding principles of fairness, accountability, and trustworthiness is crucial to maintain the legitimacy of dispute resolution mechanisms. Subsequent sections explore AI’s relevance and current applications in dispute resolution, offering examples to illustrate its potential and limitations. As AI’s presence in dispute resolution continues to expand, it is essential to navigate the evolving landscape with careful attention to ethical and procedural considerations. AI-DR represents a significant evolution in dispute resolution methods, promising efficiency and accessibility while necessitating careful management of its implications for fairness and justice.
