ABSTRACT
Article 3 (5) SGD offers Member States the possibility to exclude contracts for the sale of second-hand goods sold at a public auction from the scope of the Directive; similarly. In addition, they may (also) provide that, in the case of second-hand goods, the seller and consumer may agree to shorten the period for liability of the seller to a period of one year. In this paper, I will address the question whether these provisions contribute to sustainability, or that different or additional rules for the sale of second-hand goods need to be developed in order to strengthen sustainability.
