ABSTRACT
The EU has developed a wide body of instruments designed to ensure that consumers are provided with clear and correct information on the contract they are about to conclude. Those instruments are primarily pre-contractual information duties which number is being constantly increasing in various legal acts on consumer protection.
As recent EU directives on consumer protection provide for full harmonisation – rather than minimum – consumer law in all Member States became more and more similar. However some discrepancies are still occurring, depending on the way of EU law implementation and local practice. Thus the aim of this article is to shed some light on Polish law, especially its provisions concerning consumer protection and problems arising primarily due to incorrect transposition of EU directives.
Article also focuses on main issues concerning informed consent in EU consumer law as well as Polish legal order. The main question, that arises in the context of extensively devolved consumer protection law system – is consumer consent really informed? This article is devoted, among others, an attempt to answer that question.
