ABSTRACT
Alarmingly, there is little to no research on whether South African company law regulates AI’s conduct, the decisions of company directors to use the technology, and whether the current regulation (if any) is enough. However, it would be irresponsible not to investigate this problem given the impelling facts that: (a) South African businesses are leading Africa in incorporating AI into their operations. (b) There are plans for the exponential development, deployment, and use of the technology in the country. (c) AI presents significant risks for company stakeholders.
