Serena Faccio, ‘Claiming rights to Augmented Space: current and future scenarios’

ABSTRACT
Location-Based Services (LBSs) make use of Global Positioning System (GPS) coordinates as well as other technical means to locate the user and to provide targeted information. Said information appears in a unique place on Earth, eg in the form of a virtual experience. The combination of such a place in the real world and its counterparty in the ‘mirrorworld’ in location-aware applications can be called Augmented Space (AS).

This article tackles how disputes on AS may find a solution within the main areas of private law, including property law, IP law, privacy and personality rights and commercial law. The author depicts possible scenarios for each of said areas, with reference to different stakeholders.

AS-related disputes represent a timely and practical issue. Such controversies are predicted to increase once Augmented Reality (AR) technologies make a breakthrough, exploiting more engagingly the virtual space connected to real land. For this reason, this article will also present forward-looking legal solutions that can be found in nascent literature in this area.
