ABSTRACT
This article deals with the liability, from a trade mark perspective, of a specific type of internet service providers, namely operators of online marketplaces. Can they be held liable for trade mark infringement? Alternatively, can they rely on the hosting exemption and how far-reaching are their obligations with respect to content posted on their platforms? Can they be required to provide coordinates of the persons or businesses behind such content? Much depends on the hat they are wearing.
