Noel McGrath, ‘Transacting in a Vacuum of Property Law’

Abstract:
Bitcoin is an electronic payment system which allows for value to be transferred from one person to another using electronic coins known as bitcoins. Title to bitcoins is recorded using a distributed electronic database known as the blockchain. This paper considers the status of bitcoin as a matter of domestic English property law. It considers, and rejects the argument that bitcoin should be thought of as a form of money, and instead argues that bitcoin is best thought of as a novel form of chose in action.
